Terms of Service

PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY BEFORE SUBSCRIBING TO OR USING THE SERVICE. CHECKING THE ACCEPTANCE BOX AT CHECKOUT, OR SUBSCRIBING TO OR USING THE SERVICE, IS THE LEGAL EQUIVALENT OF SIGNING THIS AGREEMENT AND AGREEING TO BE BOUND BY IT.

These Terms of Service (“Terms”) govern your use of problee.app and app.problee.app (the “Service”), operated by Alony Services LLC, DBA Problee (“Problee”, “we”, “us”), a Texas limited liability company. By subscribing, accessing member areas, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

Plain-English summary first, details below:

Problee is a probability and analytics publication. It is NOT financial advice, it never places trades, it never touches your money, and it never guarantees results. Markets involve risk — you can lose money, and every trading decision you make is 100% yours. We publish our engine’s full graded track record, wins and losses alike, precisely so you can judge it yourself.


1. What the Service is (and is not)

Problee is a self-grading probability engine: it publishes statistical estimates, market-physics indicators, and a public, automatically graded track record for short-term cryptocurrency market movements, computed from public exchange data under uniform, automated methodologies.

The Service is not:

  • Financial, investment, trading, legal, or tax advice. Nothing on the Service is a recommendation to buy, sell, hold, enter, size, maintain, or close any asset, contract, or position.
  • A broker, dealer, exchange, or money manager. Problee never connects to your trading accounts, never places orders, never holds or touches client funds.
  • A guarantee of anything. Probabilities are estimates. A 70% estimate loses roughly 3 times in 10 by definition. Past performance — including our own published track record — does not guarantee future results.

Meaning of displayed analytics. Terms such as “edge”, “lean”, “up”, “down”, “conviction”, “wave”, lifecycle states, confidence percentages, and similar labels describe outputs of Problee’s uniform statistical models under specified reference assumptions. They do not state that any contract is mispriced at an executable market price, do not account for your costs or circumstances, and are not instructions or recommendations to take any action. Before making any decision outside the Service, you must independently evaluate venue prices, liquidity, spreads, fees, settlement rules, legality, your financial circumstances, and your risk tolerance.

You can lose money trading — including more than any subscription fee you pay us. A correct forecast can still correspond to a losing transaction once prices, fees, spreads, slippage, and timing are accounted for. If you need financial advice, consult a licensed professional.

2. Impersonal publication; no advisory relationship

  • Impersonal publication. Problee publishes the same generally available analytics and probability outputs to all subscribers of the same product tier and market view. Problee does not request, receive, or use information about any subscriber’s assets, positions, objectives, financial condition, risk tolerance, tax status, or personal circumstances to create or modify those outputs.
  • No individualized advice or monitoring. Outputs are generated under uniform methodologies and automated publication schedules, not in response to any individual subscriber’s request or circumstances. Problee does not recommend position sizes, determine suitability, monitor subscriber accounts, or contact subscribers with personalized instructions to enter, hold, or exit any transaction.
  • Subscription fees buy a publication. Fees purchase access to an informational publication and its supporting historical record. They are not transaction-based compensation, performance fees, custody fees, or brokerage commissions, and Problee receives no compensation based on whether you trade or profit.
  • No relationship of trust. Use of the Service does not create an investment-adviser, commodity-trading-adviser, broker, dealer, fiduciary, agency, client, or account-management relationship. No employee or automated feature is authorized to create such a relationship on Problee’s behalf.

3. Eligibility

You must be 18 years or older and legally able to enter contracts. You are responsible for ensuring that your use of the Service, and any trading you choose to do elsewhere, is legal in your jurisdiction.

4. Independence

Problee is not affiliated with, endorsed by, or sponsored by any exchange or trading platform, including Kalshi, Polymarket, Coinbase, Kraken, or Bitstamp. All trademarks belong to their respective owners. References to third-party platforms are informational. Third-party sites and services are governed by their own terms.

Trading venues impose their own membership, eligibility, jurisdiction, fee, and settlement rules, which change without our knowledge. You are solely responsible for reading and complying with any venue’s terms, and for confirming that trading is available and lawful where you are. Venue prices are formed by market participants — which may include market makers operating under venue incentive programs — and venue liquidity and spreads vary by market and by hour. Nothing on the Service describes, predicts, or guarantees the price at which any venue order of yours would actually execute.

5. Accounts, access links, and security

  • Provide accurate information and keep your credentials and personal dashboard access links private.
  • Access is personal and non-transferable. Membership access (including signed access links) identifies you; sharing it with others is grounds for suspension or termination. One active subscription covers one authorized user.
  • Notify us promptly at [email protected] if you suspect your access has been compromised. We may revoke and reissue access links at any time for security reasons.
  • We may suspend accounts that abuse, attack, scrape, or attempt to disrupt the Service.

6. Subscriptions, trials, billing, and cancellation

  • Billing. Paid memberships bill on a recurring basis — monthly or annual, as selected at checkout — through our third-party payment processor (currently Stripe). Problee does not receive or store your full card details. The price, renewal frequency, and applicable taxes are displayed at checkout and in your purchase confirmation. By subscribing you authorize the recurring charge to your payment method until you cancel.
  • Free trial (monthly plans). Where displayed at checkout, new subscribers to a monthly plan may receive one 3-day (72-hour) free trial. A valid payment method is required to start the trial. If you do not cancel before the end of the trial, your subscription automatically converts to a paid, automatically renewing monthly subscription and your payment method is charged the displayed monthly price. The checkout and confirmation state the trial end time. Annual plans do not include a trial unless the checkout expressly states otherwise. Trial eligibility may be limited to one trial per person or payment method.
  • Automatic renewal. Monthly subscriptions renew for successive one-month periods and annual subscriptions for successive one-year periods unless canceled before the renewal charge is processed.
  • Cancellation. You may cancel anytime, online, through the subscription controls in My Account on problee.app — no need to contact support. Cancellation stops future charges; access continues until the end of the period already paid. We provide electronic confirmation of cancellation. If you experience a technical problem canceling, contact [email protected] before your renewal time.
  • Refunds. Except where required by applicable law or expressly stated at checkout, charges are non-refundable once a trial has converted or a paid period has begun, and we do not prorate partially used periods. This does not limit any non-waivable right under applicable law. We may issue refunds or credits at our discretion (for example, for a duplicate charge, verified billing error, or extended outage); doing so once does not oblige us to do so again.
  • Price changes. We may change prices with at least 14 days’ notice; changes apply from your next billing cycle. If you disagree, cancel before renewal.
  • Payment failures and chargebacks. We may retry failed payments and suspend access while payment is outstanding. We may provide transaction and access records to payment processors in response to disputes, and may terminate accounts involved in knowingly fraudulent chargebacks. Nothing here limits your card-network or statutory rights.

7. Acceptable use

You agree NOT to:

  • Redistribute, resell, republish, or provide third parties systematic access to the Service’s data, signals, or content (including via scraping, bots, mirroring, or bulk export beyond the features your membership provides);
  • Reverse engineer or attempt to extract the engine’s models or parameters;
  • Interfere with the Service’s operation or security;
  • Use the Service for any unlawful purpose.

Personal, non-commercial sharing of occasional screenshots (e.g., a graded result on social media) is welcome — attribution appreciated.

8. Intellectual property and feedback

The Service’s software, user interface, design, text, branding, and the selection, arrangement, and compilation of its data and outputs belong to Alony Services LLC. Your subscription grants a limited, personal, non-exclusive, non-transferable license to use the Service for your own information during your membership. No ownership of third-party market data is claimed or transferred. If you voluntarily submit feedback or suggestions, you grant us a non-exclusive, royalty-free license to use them to improve the Service; we claim no ownership of your ideas beyond that license.

9. Experimental, prototype, and laboratory features

Certain features, models, displays, datasets, historical replays, or metrics may be labeled “EXPERIMENTAL”, “PROTOTYPE”, “LABORATORY”, “SHADOW”, “BETA”, or similar. These are provided for evaluation and information only; they may have been tested for a limited period, may contain errors or unstable behavior, and may be modified, recalibrated, or removed at any time. Historical laboratory results are simulations or replays under stated assumptions and are not part of Problee’s live forward track record unless expressly identified as such. A prototype label does not mean an output has achieved any stated reliability, and you agree not to rely on prototype features for trading decisions.

Corrections. We may correct grades, calculations, labels, metrics, or historical records when we identify an error, source-data revision, grading discrepancy, or methodological defect. Material corrections are documented through dated public changelog entries or visible correction seals, and we may preserve both the original and corrected values for auditability. A correction practice is not a promise that all errors will be detected or corrected immediately.

10. Availability and changes

The Service is provided “AS IS” and “AS AVAILABLE”. We aim for high uptime but do not guarantee uninterrupted access; third-party data feeds may fail or lag. We may modify, add, or remove features — and improve or retune our models (with changes disclosed through our public changelog practices) — at any time.

Electronic access risk. Accessing information over the internet involves many interrelated systems — hardware, software, hosting, data feeds, and network infrastructure — any of which can fail, lag, or malfunction. During an outage or degradation, the Service (including live prices, calls, lifecycle states, and grades) may be unavailable, delayed, or incomplete, and market events will continue to occur and resolve regardless. You assume these risks of electronic access.

11. Accuracy, data, and no reliance

Market data comes from third-party public sources and may be delayed, incomplete, or wrong. Our published grades are computed automatically against our own reference feeds and may differ from any venue’s official settlement values (razor-thin “photo finish” results are flagged for this reason). Displayed venue-related figures may differ from executable bid/ask prices, and our probabilities do not include fees, spreads, slippage, liquidity, taxes, or your circumstances unless expressly stated.

No reliance. The Service’s probability estimates, bands, and labels are outputs of mathematical models, not representations of fact, and may contain design flaws, computational errors, or systematic biases — our public autopsy and changelog practices exist because errors occur. You agree that you do not rely on the accuracy, completeness, or timeliness of the Service’s internal calculations in making financial decisions. We make no warranty of accuracy, completeness, merchantability, or fitness for a particular purpose.

12. Limitation of liability

To the maximum extent permitted by law:

  • Problee is not liable for any trading or investment losses, lost profits, or indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service — even if we were advised such damages were possible.
  • Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim (or $50 if you paid nothing).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the fullest extent permitted.

13. Indemnification

You agree to indemnify and hold harmless Alony Services LLC and its members, officers, and agents from third-party claims arising out of your breach of these Terms, your unlawful use of the Service, your infringement of third-party rights, or your unauthorized sharing or redistribution of access or content.

14. Termination

You may stop using the Service anytime. We may suspend or terminate access for breach of these Terms (including access sharing or redistribution), with refunds at our reasonable discretion. Sections 1, 2, 8, 11, 12, 13, and 15 survive termination.

15. GOVERNING LAW, DISPUTES, CLASS-ACTION AND JURY WAIVER

Please read this section carefully — it affects your rights.

  • These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
  • Informal resolution first. Before filing any claim, you agree to email [email protected] with a description of the dispute and attempt good-faith resolution for 30 days.
  • Forum. Disputes will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction and venue. Either party may instead bring an individual claim in small-claims court where eligible.
  • CLASS-ACTION WAIVER. To the maximum extent permitted by law, all claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
  • JURY-TRIAL WAIVER. To the maximum extent permitted by law, both parties waive the right to a trial by jury.
  • If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court on an individual basis, and this section remains in effect for all other claims.

16. Electronic communications

We deliver notices — including billing, renewal, trial-conversion, cancellation confirmations, and Terms updates — by email to your account address or by posting within the Service, and you consent to receive them electronically. Keep your email address current. Transactional notices are separate from marketing email, which you may opt out of at any time.

17. Force majeure

Problee is not liable for delays or failures caused by events beyond our reasonable control, including exchange or data-provider outages, internet or hosting failures, labor actions, war, or acts of government or nature.

18. General terms

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Problee regarding the Service.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice.
  • Headings are for convenience only. No third-party beneficiaries are intended.

19. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced on the website with a revised “Last updated” date, and material changes to Section 15 apply prospectively only. Continued use after changes means you accept them; for material changes we may additionally require affirmative acceptance.
